OverviewBuying a property in Spain is in reality a simple process.
The Spanish system is set up to protect both the buyer and seller, providing that certain simple steps are taken. We would however stress that the information below is intended only to help you in your understanding of the processes involved and is no substitute for proper professional legal advice to ensure that you are fully informed at all time when making such a financial commitment.
While you are looking with us for the property of your dreams, we will start already to inform you about all necessary steps and details of the purchase and the following procedure. And if you wish so, you can make additionally appointments with the gestoría or lawyer. You may also wish to contact the Town Planning Department of the Local Council in order to make sure, that your property won’t be affected by any public or private building project, and we will be pleased to help you with these investigations, making appointments and translating for you.
At the same time you should apply for a NIE – a tax identification number. You will need this for the purchase; in case of not having such a NIE, you pay additionally 3% tax on the purchase. Our gestoría/lawyer will organise this for you.
Once you are satisfied with the offer, we make a contract between our company and you -for you to hold the property paying a deposit and for us to commit ourselves to go ahead with the development of the project according to your wishes. When everything is ready and the paperwork completed, you will sign for the Title Deeds (Escritura Pública) in a Notary, which converts you into the owner of the property. And then the actual building process will start on base of a separate building contract.
